This Privacy Policy describes how Markets for Makers LLC (“M4M,” “we,” “us,” or “our”) collects, uses, discloses and protects personal information about you, and the choices available to you. It applies to personal information we collect when you interact with us online (including tickets.marketsformakers.com and marketsformakers.com) or offline at our markets (collectively, our “Services“).

We currently operate markets in Austin, Boston, Brooklyn, Chicago, Dallas, Houston, Jacksonville, Miami, Nashville, Los Angeles, San Diego, Tampa, and West Chicago, and expect our footprint to keep growing. Because we operate in California, Texas, and Tennessee specifically, this Policy is written to satisfy those states’ privacy laws in addition to describing our practices generally to all visitors and customers.

We may change this Privacy Policy from time to time. If we make material changes, we will revise the “Last Updated” date above and, where appropriate, provide additional notice (such as a homepage banner or email notification). We encourage you to review this policy periodically.

1. Personal Information We Collect

Information you provide directly, such as when you buy a ticket or product, sign up for email/text updates, apply as a maker or sponsor, enter a contest or survey, contact customer support, or otherwise communicate with us. This can include:

  • Identifiers: name, email address, mailing/billing/shipping address, zip or postal code, and phone number.
  • Payment information: the last four digits of your payment card and billing address. (Full card numbers are entered directly with, and processed and encrypted by, our payment processors and are not stored on our servers — see Section 5 and Section 7.)
  • Demographic information and any other information you choose to provide (for example, in a survey response or customer support message).
  • Maker/vendor and sponsor application information, such as business name and contact details, if you apply to sell at or sponsor one of our markets. (Maker and sponsor relationships are also generally governed by a separate vendor/sponsor agreement; this Policy covers any personal information collected through our Services in connection with that process. We do not collect tax ID numbers or banking details through these Services — any payout-related information is handled separately, outside these Services.)

Information about your use of our Services, such as the tickets, products or events you purchase or express interest in, and your order/transaction history.

Information we collect automatically when you use our Services:

  • Log and device information: IP address, browser type, operating system, device hardware/model, access times, pages viewed, and referring links.
  • Transaction information: product/ticket details and the date of purchase.
  • Cookies, pixels, and similar tracking technologies: we (and our service providers and advertising partners) use cookies, web beacons/pixels, and similar technologies — including Google Analytics, Google Tag Manager, Microsoft Clarity, Hotjar, Meta Pixel, and TikTok Pixel — to recognize your browser or device, understand browsing and purchasing behavior, tailor communications, and measure campaign effectiveness. Some of these tools (such as Microsoft Clarity and Hotjar) may record how you interact with our site (such as clicks, scrolling, and mouse movement) to help us understand and improve the user experience. See Section 8 (“Cookies, Tracking & Online Advertising”) below.

Information we collect from other sources, such as national change-of-address databases (to verify mailing addresses), social media platforms (if you interact with us there), and our advertising and analytics partners.

Information we derive, such as inferring your general location from your IP address, or your likely interests based on your browsing or purchase behavior.

We do not collect precise (GPS-level) geolocation, government ID numbers, banking or tax identification numbers, or other “sensitive personal information” as defined by the CCPA through our Services, and we do not use facial recognition or other biometric identification technology — our event photography and videography (Section 11) is captured and used manually, without any automated identification of individuals in photos or video.

2. Why We Collect and Use Personal Information

We use personal information for the following business purposes:

  • Ticket and order fulfillment: processing ticket and product purchases and payments; sending confirmations and receipts; and delivering the products and Services you request.
  • Customer support: responding to your questions, comments and requests.
  • Event and operational communications: sending updates related to an event or order — including schedule changes, weather-related closures or rescheduling, and account/security notices — by email and, where you’ve opted in, by text message.
  • Marketing: with your consent where required, sending you promotions, discounts, new-market announcements and other news we think will interest you, by email (through Flodesk) and/or text message (through SimpleTexting).
  • Analytics and Service improvement: understanding how our Services are used, conducting internal research, and improving our website, ticketing flow, and in-market experience.
  • Advertising: working with advertising partners — currently Google, TikTok, Meta, Snapchat, and LinkedIn, and potentially others in the future — to promote our markets and measure the effectiveness of that advertising, as described in Sections 4 and 8.
  • Fraud prevention and security: detecting, investigating and preventing fraud, abuse, security incidents and illegal activity, and verifying identity.
  • Legal compliance: complying with applicable law, regulation, legal process and governmental requests, and enforcing our Terms of Service and other agreements (see Section 6).
  • Sponsor reporting: sharing aggregate attendance figures (for example, total attendee counts at a given market) with event sponsors. We do not share attendees’ names, email addresses, phone numbers, or other personal information with sponsors.
  • Loyalty and financial incentive programs, if and when we introduce one (see Section 10).

3. Phone Numbers & Text Messaging (SMS) — Use, Consent and Opt-Out

If you provide your mobile phone number, we use it for M4M communications and our texting program, which we operate through our SMS platform, SimpleTexting. This can include:

  • Transactional messages, such as order/ticket confirmations and event or weather-related schedule and rescheduling updates; and
  • Marketing messages, such as promotions, discounts and event announcements — sent only if you separately opt in to marketing texts, at a frequency of approximately 1–2 messages per month.

Opting in is entirely voluntary. Consent to receive text messages is never a condition of purchasing a ticket or product from us, and the checkbox for text updates at checkout is unchecked by default — you choose whether to opt in.

Message frequency: marketing texts are sent approximately 1–2 times per month; transactional texts (such as weather/schedule alerts) are sent only as needed. Message and data rates may apply depending on your mobile carrier and plan.

How to opt out: reply STOP to any text message from us, uncheck the text-updates option in your account, or contact us at hello@marketsformakers.com at any time. Reply HELP for assistance. Opting out of marketing texts does not opt you out of non-marketing, transactional texts tied to an order or ticket you’ve already placed, where permitted by law.

We do not sell, rent, or share your phone number or your SMS opt-in/opt-out status with third parties for their own marketing purposes — under any circumstance. We share your phone number only with SimpleTexting, solely to operate our texting program, and as otherwise described in Section 5. See also our Terms of Service.

4. Sale or Sharing of Personal Information

We do not sell personal information to third parties in exchange for money.

We do allow certain advertising and analytics partners — currently Google, TikTok, Meta, Snapchat, and LinkedIn, and potentially other platforms in the future — to collect identifiers, commercial information, and internet/network activity information via cookies, pixels and similar technologies on our Services, so that we and they can show you ads tailored to your interests and measure their effectiveness. Under the CCPA (as amended by the CPRA), this type of arrangement can be considered a “sale” or “sharing” of personal information (specifically, “sharing” for cross-context behavioral advertising), even though no money changes hands.

You can opt out of this sale/sharing of personal information for advertising purposes at any time:

  • Through the tools described in Section 8 (“Cookies, Tracking & Online Advertising”); or
  • By enabling a Global Privacy Control (GPC) or similar opt-out preference signal in your browser, which we honor as a valid opt-out request for the browser/device on which it is enabled, where required by applicable law; or
  • By emailing hello@marketsformakers.com with an opt-out request.

Phone numbers and SMS opt-in/opt-out data are never included in any sale or sharing of personal information, for any purpose, under any circumstance — see Section 3.

5. Sharing of Personal Information

Apart from the advertising-related sharing described in Section 4, we share personal information with:

  • Payment processors, including WooCommerce Payments (WooPayments) and Stripe for online ticket and product purchases, and Square for at-door/in-person payments, to process payments securely;
  • Website and e-commerce platform providers, including WooCommerce and FooEvents, which power our online store and ticketing, to operate our Services;
  • Email and SMS/text messaging platforms — Flodesk (email) and SimpleTexting (SMS) — solely to send the communications described in Sections 2 and 3 on our behalf;
  • Analytics and site-behavior tools, including Google Analytics, Google Tag Manager, Microsoft Clarity, and Hotjar, to help us understand and improve use of our Services;
  • Advertising partners, as described in Section 4;
  • Accessibility tools, including EqualWeb, which powers the accessibility widget on our site;
  • Event sponsors, who receive only aggregate attendance figures, never individual attendees’ names, email addresses, or phone numbers;
  • Customer-support tools, to respond to your inquiries;
  • Other vendors, consultants and service providers who need personal information to perform work on our behalf, such as fraud prevention and marketing/advertising support;
  • Our current and future parents, affiliates, subsidiaries and other commonly owned/controlled companies;
  • Our lawyers and other professional advisors, where necessary to obtain advice or protect our business interests;
  • A buyer or successor in connection with a merger, sale of assets, financing, or transfer of all or part of our business;
  • The public, by posting your product review or other user content you submit, at our discretion; and
  • Anyone else, with your consent or at your direction.

Service providers who receive personal information from us are contractually restricted to using it only to perform services on our behalf, not for their own independent marketing purposes.

6. Legal Disclosures

We may access, preserve and disclose personal information if we believe in good faith it is necessary to: comply with an applicable law, regulation, legal process, subpoena, or court order, or respond to a governmental or law-enforcement request; detect, prevent or address fraud, security or technical issues; or protect the rights, property, or safety of M4M, our customers, our employees, or the public, as required or permitted by law.

7. Data Security

We maintain reasonable administrative, technical and organizational safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration or destruction. This includes limiting access to our website and systems’ backend to authorized personnel only, and relying on WooPayments’ built-in encryption of payment card data and its automated fraud-detection flagging for online transactions. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

8. Cookies, Tracking & Online Advertising

Cookies. Most web browsers accept cookies by default. You can typically set your browser to remove or reject cookies, though this may affect the availability and functionality of our Services. We are in the process of implementing a cookie-consent management tool to give visitors more granular, upfront control over non-essential cookies.

Analytics and advertising. We use Google Analytics, Google Tag Manager, Microsoft Clarity, and Hotjar for analytics and to understand how visitors use our site (including, for Clarity and Hotjar, session-replay-style tools that can record on-page interactions such as clicks and scrolling). We also work with advertising partners — currently Google, TikTok, Meta, Snapchat, and LinkedIn — using tools such as the Meta Pixel and TikTok Pixel, to serve and measure advertising both on our Services and elsewhere on the internet.

Your choices. To opt out of interest-based advertising, visit optout.networkadvertising.org and aboutads.info/choices. You can also adjust your ad settings directly on platforms like Google, Meta, TikTok, Snapchat, and LinkedIn, or use a Global Privacy Control signal as described in Section 4. These choices must generally be renewed on each browser and device you use.

9. Data Retention

We generally retain personal information for as long as your relationship with us continues and for as long afterward as needed to operate our business — including order history, account information, and marketing preferences — and we do not currently delete this information on a fixed schedule. If you would like us to delete your personal information, you may submit a deletion request as described in Section 10, and we will honor verified requests as required by applicable law, subject to any exceptions that law allows (for example, information we need to retain for tax, accounting, fraud-prevention, or legal-compliance purposes).

10. Your Privacy Rights (California, Texas, Tennessee, and Other U.S. States)

Depending on where you live, you may have rights with respect to your personal information under state privacy laws such as the California Consumer Privacy Act (as amended by the CPRA), the Texas Data Privacy and Security Act, the Tennessee Information Protection Act, and comparable laws in other states. Subject to certain exceptions and verification requirements, these rights can include the right to:

  • Know/Access the categories and specific pieces of personal information we have collected, used, disclosed or sold/shared about you, and the categories of sources and third parties involved;
  • Correct inaccurate personal information we maintain about you;
  • Delete personal information we have collected from you;
  • Opt out of the sale or sharing of your personal information (see Section 4) and of certain targeted/cross-context behavioral advertising;
  • Data portability — receive a copy of your personal information in a portable format;
  • Non-discrimination for exercising any of these rights; and
  • Appeal a decision we make regarding your request, where applicable.

We do not knowingly collect or use “sensitive personal information” (as defined by the CCPA) for purposes that would trigger a right to limit its use; if that changes, we will update this Policy accordingly.

How to exercise your rights: email us at hello@marketsformakers.com with your request and the state you reside in. We will verify your request (for example, using identifiers such as your name, email address and phone number on file) before acting on it. If you use an authorized agent registered with the California Secretary of State, we may request evidence of your written authorization or power of attorney. We will not discriminate against you for exercising any of these rights.

Email is currently our only channel for privacy requests; we are working on adding a second channel (such as a dedicated phone line) and will update this section once it is available.

California-Specific Disclosures (CCPA)

Categories collected (preceding 12 months): identifiers (including phone number), information described in Cal. Civ. Code § 1798.80(e) (such as name and payment details), characteristics of protected classifications under California or federal law (only where voluntarily provided, e.g., in a survey), commercial information (purchase history), internet or other electronic network activity information, geolocation data (approximate, from IP address), audio/visual information (in connection with our photography/video notice), professional or employment-related information (if provided, e.g., in a maker/sponsor application), inferences drawn from the above, and other information that identifies or relates to you. See Section 1 for details and sources. We do not collect sensitive personal information as defined by the CCPA.

Purposes: see Section 2.

Categories disclosed for a business purpose (preceding 12 months): identifiers, information described in Cal. Civ. Code § 1798.80(e), commercial information, internet/network activity information, geolocation data, and inferences — disclosed to the categories of service providers and other recipients described in Section 5.

Categories sold/shared (preceding 12 months): identifiers, commercial information, and internet/network activity information, made available to advertising partners as described in Section 4. We do not sell or share phone numbers or SMS opt-in/opt-out data.

Notice of Financial Incentives. We may offer discounts, coupons or other benefits for signing up to our marketing emails/texts or joining a loyalty program, if and when we introduce one. Participation involves our collection of identifiers (such as name, email and phone number) and commercial information (such as purchase history). You may opt in by following the applicable sign-up instructions, and opt out at any time by contacting hello@marketsformakers.com; the value of your personal information is reasonably related to the value of the offer or discount presented to you.

Minors. We do not knowingly sell or share the personal information of consumers we know to be under 16 years old. See Section 12 for our children’s privacy practices generally.

11. Photography and Videotaping

By entering our markets you understand you may be photographed, filmed or videotaped, and you grant Markets for Makers LLC the unqualified, perpetual right to use your likeness or recording for broadcast, exhibition or any legitimate use, without compensation, as described further in our Terms of Service. Our event photography and video is captured and used manually by our team — we do not use facial recognition or other automated biometric identification technology to identify individuals in photos or video.

12. Children’s Privacy

Our Services are intended for a general audience and are not directed to children, and we do not knowingly collect personal information from children under 13 (or the relevant minimum age in your jurisdiction) through our Services, consistent with the Children’s Online Privacy Protection Act (COPPA). Our SMS and marketing email programs are intended for adults capable of entering into a purchase. Children may attend our markets, but only when accompanied by a parent or guardian, who is responsible for that child while on-site. If you believe a child has provided us with personal information, please contact us at hello@marketsformakers.com and we will work to delete it from our records.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make changes, we will revise the “Last Updated” date at the top of this page and, for material changes, provide additional notice where appropriate (such as a homepage banner or email). Your continued use of our Services after changes are posted constitutes acceptance of those changes.
